Introduction

MotionFacts.com (“we,” “us,” or “our”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the policy below toward copyright infringement. We reserve the right to block access to or remove material that we believe in good faith to be copyrighted material that has been illegally copied and distributed by any of our users and to terminate repeat infringers.

Notice of Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that any material on our website infringes upon your copyright, you may submit a written notification of claimed infringement to our Designated Agent.

To be effective, the DMCA notice must include the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL of the page where the material is located).
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Once we receive a proper and complete infringement notification, we will remove or disable access to the infringing material and take reasonable steps to notify the user who posted the material that it has been removed.

Counter-Notification

If you believe that the material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by submitting a written notification to our Designated Agent.

Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which MotionFacts.com may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.

Upon receipt of a valid counter-notification, we may, in our discretion, send a copy to the original complaining party informing them that we may replace the removed material or cease disabling it in 10 business days. Unless our Designated Agent receives notice from the original complaining party that they have filed a court action seeking an order to restrain the user from engaging in infringing activity, we may replace or restore access to the material in 10 to 14 business days.

Repeat Infringers

It is our policy to terminate the user accounts of repeat infringers in appropriate circumstances.
